LeanOn DE

Terms of Use LeanOn Patient

For the LeanOn Patient app (the web app at patient.weleanon.com and the Android and iOS versions). How we handle data is in the app's privacy policy. The imprint is under Legal. The German version is the binding one and is available at Nutzungsbedingungen.

1. Provider and scope

The provider of the LeanOn Patient app (the "app") is:

Constantin Selzer
Altöttinger Str. 8, 81673 Munich
Germany
E-mail: kontakt@weleanon.com

These terms apply to use of the app as an Android app, an iOS app and a web app, between you and the provider. The terms of the platform you obtain the app from (Apple, Google) apply in addition and are not replaced by these.

The app is free. There is no user account, no sign-in, no in-app purchases and no advertising.

2. What the app is

The app is a personal diary for the time of cancer treatment. You record how a day was, keep documents in one place, note appointments, and produce an overview from them that you can hand on yourself.

Everything you enter is your own record.

3. What the app is not

The app is not a medical device. It is not intended to diagnose, prevent, monitor, predict, treat or alleviate disease. It makes no diagnosis, gives no recommendation, does not assess your entries and monitors nothing.

In particular:

  • The app does not warn. It raises no alarm at any value, and nobody is notified when you enter something.
  • Nobody reads your entries. Neither the provider nor your treatment team has access to the app on your phone.
  • The history views show your own entries. They contain no evaluation and no statement about whether a course is good or bad.
  • The phrased summary, where your device supports it, restates your entries in sentences. It adds no judgement.

The app does not replace medical advice, diagnosis or treatment. Do not make any decision about your treatment on the basis of the app. If a symptom worries you, contact your treatment team.

In an emergency call 112. For urgent medical advice outside surgery hours call 116 117. Never use the app for either.

4. Test phase

The app is in a test phase and is made available to selected testers. That has consequences you should know before using it:

  • The app may contain errors. Features may change, be added or be removed.
  • There is no entitlement to availability, to any particular feature, or to the test being continued.
  • The test may be ended at any time. After that you receive no further updates.
  • Do not keep important information only in the app. Use the export regularly.

Participation is voluntary and may be ended at any time without giving reasons by uninstalling the app. No disadvantage arises for you from doing so. The participant information you received before the test applies in addition.

5. Requirements for use

The app is intended for adults. You may use it only if you are 18 or older.

You need your own phone or your own browser. Protection of the data on your device depends on your device: use a device lock and your operating system's encryption.

6. Your data is on your device

Your entries, documents and appointments are stored on your device. They are not uploaded to the provider's servers. There is no copy held by the provider from which anything could be restored.

It follows that if you lose the device, reset it, uninstall the app or clear the site data, your entries are irrevocably lost. The provider cannot restore them and owes no restoration. The app offers an export with which you can make your own copy at any time. Backing up your data is your responsibility.

When you export, print or share data, it leaves the app. Where it goes then is your decision.

The details are in the privacy policy.

7. Feedback

The app contains a function for sending feedback to the provider. It is the only transmission to the provider, and before sending you see exactly which fields are transmitted.

Do not put anything in feedback that you would not want disclosed, and nothing about other people. Feedback is used solely to improve the app.

Do not use feedback to seek urgent advice. It is not monitored and is not read within any particular period.

8. Rights in the app and in your content

Your content is yours. The provider acquires no rights in what you enter and gains no knowledge of it.

In the app itself you receive a simple, non-transferable right of use on your devices for the duration of the test phase. The app is licensed, not sold. Reverse engineering, modifying or distributing the app is not permitted except where the law expressly allows it.

The open-source components used and their licences are listed in the app under "About and legal".

9. Availability and changes

The provider owes no particular availability. The provider may change or restrict the app or discontinue it. If it is discontinued, reasonable notice will be given so that you can export your data, as far as that is possible and reasonable.

10. Liability

The provider is liable without limitation

  • for intent and gross negligence,
  • for damage arising from injury to life, body or health,
  • under the German Product Liability Act, and
  • where a guarantee has been given.

For simple negligence the provider is liable only for breach of a material contractual obligation, that is an obligation whose fulfilment makes proper use of the app possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical of this kind of contract.

Liability is otherwise excluded. That applies in particular to the loss of data held only in the app, to the extent the loss is due to no export having been made.

These limitations do not apply to claims you have as a consumer under mandatory law.

11. Changes to these terms

The provider may change these terms where a change to the app, to the law or to case law gives cause. You will be informed of a change in the app or by e-mail where a contact address is held. If you do not agree with a change, you may stop using the app and uninstall it.

12. Governing law and dispute resolution

German law applies. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.

The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
